SINGAPORE: In a groundbreaking decision on October 23, the High Court has reversed the deregistration of renovation contractor Concept Werk, granting homeowner Lye Yew Cheong the opportunity to pursue his renovation claims in court. This ruling not only marks a significant win for Mr. Lye but also shakes up the often-turbulent renovation sector in Singapore, notorious for its consumer complaints.

Background of the Dispute

The conflict began back in July 2021 when Mr. Lye hired Concept Werk, helmed by directors Keith Xie and Sonia Tay, to renovate his HDB flat. The initial project was estimated to cost $123,000, with Mr. Lye making a 20% deposit upfront. As the renovation dragged on, costs ballooned to $144,656, turning what should have been a dream home makeover into a prolonged nightmare. After vacating their home, Mr. Lye and his wife faced numerous delays and defects, keeping them at bay until June 2022—over six months past the promised completion.

Despite assurances from Ms. Tay that rectification of defects would occur at no extra cost, communications plummeted by March 2023, worsening the situation. Complicating matters further, Ms. Tay resigned in October 2021, and Mr. Xie subsequently closed the company’s accounts, leading to Concept Werk's deregistration in May 2023, even as disputes loomed over the unfinished work.

Pursuing Justice

In a desperate bid for justice, Mr. Lye turned to the Small Claims Tribunal in October 2023, only to discover that Concept Werk had effectively vanished from the corporate register. However, he remained resolute and sought relief directly from the High Court to revive the company’s registration. The Accounting and Corporate Regulatory Authority (Acra) did not oppose his application, but Mr. Xie contested it.

High Court Ruling and Implications

After deliberations, on September 16, High Court Judge Goh Yihan ruled in Mr. Lye's favor, ordering Acra to restore Concept Werk’s registration as if it had never been dissolved. Justice Goh remarked that Mr. Lye’s claims were substantial and warranted legal pursuit.
