The National Advertising Division (NAD), part of BBB National Programs, spearheaded the inquiry into Apple's marketing claims. While some features were indeed available to certain users, the overarching claim that all Apple Intelligence features were instantly accessible was deemed inaccurate.
Conflicting Messages and Consumer Expectations
According to the NAD, the marketing misled consumers regarding the actual availability of these AI capabilities. Although the iPhone 16 showcased features like Priority Notifications and an integration with ChatGPT, other advertised functionalities were absent at launch. Apple's small print and footnotes attempted to clarify this, but NAD ruled that these disclaimers were neither clear nor adequate.
Apple Adjusts Its Advertising Strategy
Acknowledging the NAD's recommendation, Apple chose to eliminate the misleading 'Available Now' claim instead of retracting the unfulfilled promises themselves.
